CLAY COUNTY — A Friday sentence in Clay County Court has been changed after officials noted an 85-percent requirement was statutorily incorrect for the convicted offense.
According to Clay County State’s Attorney Phillip Givens, 39-year-old Scottie Adler, of Flora was sentenced Friday to five years in prison with 85 percent of the sentence to be served. However, Givens says that sentence was incorrect pursuant to the statute.
Adler was subsequently resentenced Monday to four and a half years in the Illinois Department of Corrections on a Class 3 felony aggravated battery of a child and will be required to serve 50 percent of the new sentence. He won’t have to serve parole unless the prisoner review board finds it necessary. A press statement from Givens says the maximum sentence for that offense was five years.
Adler and his wife Miranda Adler were both arrested in 2022 and charged with four Class X felony counts each of aggravated battery to a child.
Adler pleaded guilty in April to striking a child under the age of 13 multiple times with a belt on two separate occasions in 2022. His wife is scheduled to appear in court later this month in her own case.
State’s Attorney Givens said he’s grateful for the victims in the case that a witness finally came forward. The children in this case have luckily fully recovered and are thriving.
